Terms of Service

These Terms of Service (hereinafter, the Terms) regulate the general manner of use of the Services and the distribution of rights, obligations and liability of Behind the Games, UAB (hereinafter, RAWG) and users of the RAWG API (hereinafter, Services). These Terms of Service neither govern nor define the rights and obligations of third parties.

By using our Services, you are agreeing to these Terms. Subject to these Terms, RAWG grants you a personal non-transferable right to access and use the Services.

1. General Provisions

1.1. The Services includes RAWG Video Games Databases API (hereinafter, API).

1.2. The Services are designed to help you to experience all the usage of the largest open video games database (RAWG) within your own projects.

2. Terms and Definitions

2.1. For the purposes hereof, the following terms and definitions are used:

You, User – any individual who uses the functionality of the Services and has reached the age of full legal capacity in accordance with the legislation of the country of their citizenship or any legal entity that is using the functionality of the Services.

Services, API - RAWG Video Games Databases API.

3.1. By using our Services, you are agreeing to these Terms of Service. Please stop using our Services if you do not agree to these Terms of Service.

3.2. By expressing consent, you agree to regularly check and read notifications about updates and (or) additions to the Terms.

4. Rights and Obligations

4.1. Hereunder we undertake to:

(1) comply with the Privacy Policy as well as the relevant requirements for personal data protection;
(2) duly consider incoming inquiries, complaints and comments of Users.

4.2. We have the right to:

(1) amend and (or) supplement the Terms, if necessary, including updates in accordance with the applicable law;
(2) modify, suspend or terminate operation or access to the Services, any part and/or function of the Services for any reason (but mostly for the violation of these Terms of Service);
(3) interrupt the operation of the Services or any part thereof, if it is required to perform any maintenance, bug fixes and (or) make any other modifications.

4.3. The User agrees to:

(1) submit accurate information requested for the use of the Services;
(2) comply with the Terms of Service and other rules of use of the Services (Privacy Policy) as well as any other applicable law;
(3) refrain from re-engineering (reverse engineering), decompilation and disassembly of the Services or parts thereof, refrain from actions aimed at determining the source code of the Services, refrain from actions aimed at circumvention of the software and hardware means of protection of the Services;
(4) refrain from using the Services for any purpose prohibited by applicable law or these Terms as well as incite any illegal activity or other activity that violates our rights and legitimate interests as well as the rights and legitimate interests of third parties.
(5) not to use Services for the purposes of further distribution in any way.

4.4. The User has the right to:

(1) use the functionality of the Services within the limits and in the manner permitted hereby and by the applicable law;
(2) contact RAWG for suggestions and/or complaints;

5. Data Protection

5.1. The Services may collect and process your personal data. The same applies to the process of obtaining the Services. Any collection and processing of your personal data is governed by our Privacy Policy.

6. Content of Services

6.1. All text, graphics, user interfaces, visual interfaces, photographs, names and trademarks, logos, sounds, music, images and any other audio-visual content and software code (collectively referred to as the Content), including, without limitation, the design, structure, selection, coordination, appearance, overall style, location and any other way of organising the Content as part of the Services, are protected by copyright, law on trademarks and other laws governing intellectual property and unfair competition.

6.2. Unless expressly indicated herein, no parts of the Services or the Content may be copied, reproduced, published, posted online, sent by mail, demonstrated in public, encoded, translated, transmitted or otherwise sent (including copied) to another computer, server, website or any other data medium for publication, distribution or any other commercial purpose as well as used otherwise and in any other form without our prior express written consent.

6.3. You may use the information which is specifically provided by us and can be downloaded from the Services in the form of documents (e.g. manuals, guidelines, instructions, etc.) provided that you keep copyright marks in all languages in all copies of such documents, use such information for your personal, non-commercial (not related to commercial profits) informational purposes and do not copy or post such information on any network computer or transfer it to any medium, do not make changes to such information or make additional representations or warranties relating to such documents.

6.4. All rights save those expressly granted to you in these Terms are reserved.

6.5. We do not claim ownership of any of the images or data provided by the API. We remove infringing content when properly notified. Any data and/or images one might upload to RAWG is expressly granted a license to use. You are prohibited from using the images and/or data in connection with libelous, defamatory, obscene, pornographic, abusive or otherwise offensive content.

7. DISCLAIMER

7.1. RAWG GUARANTEES NEITHER UNINTERRUPTED OPERATION OF THE SERVICES NOR THAT ITS USE OR THE USE OF ITS FUNCTIONS WILL HELP YOU OBTAIN YOUR DESIRED RESULTS. THE SERVICES AND ITS CONTENTS ARE PROVIDED ON “AS IS” AND “AS AVAILABLE” BASIS. ANY INFORMATION IN THE SERVICES MAY BE REMOVED AND/OR AMENDED WITHOUT PRIOR NOTICE. RAWG IS NOT RESPONSIBLE FOR ANY ACTIONS AND (OR) OMISSIONS OF ANY THIRD PARTY WITH REGARD TO YOUR USE OF THE SERVICES. THIS SECTION HAS THE SAME LEGAL FORCE AS ALL THE OTHERS HERE DESPITE BEING WRITTEN IN CAPITAL LETTERS.

8. Payments

8.1. Although we are promoting non-commercial experience in the game industry, some scenarios of the usage of Service might be subject to prior giving us your money (“commercial use”).

8.2. We do have 3 separate API usage plans:

8.2.1. Free plan: API is free for personal use (as long as you attribute RAWG as the source of the data and/or images and add an active hyperlink from every page where the data of RAWG is used) and is free for commercial use for projects and/or services within 20.000 requests per month. Take into account that Free plan is available for you as long as you have no more than 100.000 monthly active users or 500.000 page views per month. 8.2.2. Business plan: API will give you the opportunity to have 50.000 requests per month. You may purchase access to the Business plan via rawg.io/apidocs. Data and features available for usage within the Business plan could be found at: rawg.io/apidocs (“Business” section).
8.2.3. Enterprise plan: suitable for any projects with custom needs. Enterprise plan gives you the opportunity to have 1 000 000 requests per month. 8.3. API key will be available in your personal account after all the conditions of either personal or commercial usage are satisfied.

8.4. All the payments for the Business plan are handled via Stripe infrastructure. All the prices are established as per month.

8.5. All the restrictions for the usage within the available quantity of requests are relevant on the date of these Terms being published and might be changed by RAWG unilaterally.

9. Additional Terms

9.1. If necessary, the Terms may be altered and (or) updated at any time of operation of the Services. This applies to all the mentioned prices as well. If you disagree with amendments and/or additions hereto, you must discontinue the use of the Services and their functionality.

9.2. The Terms are an agreement between us and the User with respect to the use of the Services. Any other prior written or oral agreements or arrangements with respect to such use are hereby cancelled.

9.3. If any provision hereof is invalid or unenforceable, other provisions shall remain valid and enforceable to the fullest extent permitted by the applicable law.

9.4. Failure to enforce your strict compliance herewith cannot be construed as our waiver of any provision hereof or any right hereunder.

9.5. The law applicable to these Terms of Service is the law of Lithuania. The competent court at the location of RAWG has the exclusive jurisdiction over all disagreements and disputes arising out of or in connection with the Terms.
